This website is owned and operated by Living Well Naturopathy. By accessing this website and/or using our services you agree to be bound by the following Terms and Conditions, including any other policies referenced here. If you do not agree, please do not use this site or our services.

1. Definitions

Throughout this site, the terms “we”, “us”, “I” and “our” refer to Living Well Naturopathy.

The terms “Patient”, “Client” and “You” refer to any person accessing the website or services.

The term “Services” include naturopathic consultations (delivered online or via telephone), treatment plans, advice, referrals or recommendations of any calibre delivered by Living Well Naturopathy.

2. Qualifications

  • Bachelor of Biomedical Science (Griffith University, Gold Coast)

  • Master of Naturopathic Medicine (Southern Cross University, Gold Coast)

3. Registration / Insurance

  • NHAA membership number 160316

  • Insured with Prorisk (Professional Risk Underwriting Pty Ltd ABN 80 103 953 073 AFSL 308076)

4. Scope of Practice

Living Well Naturopathy provides complementary healthcare services. I am a qualified naturopath, not a medical doctor.

Naturopathic services are complementary and are not a substitute for conventional medical care. I do not diagnose, treat, cure or prevent diseases in the medical sense.

You should maintain an ongoing relationship with your GP and other medical specialists as appropriate. In cases of emergency or serious acute illness, contact 000 or present to your nearest emergency department.

I am not liable for any consequences arising from your decision not to follow advice from other healthcare practitioners or for delaying appropriate medical care.

5. Services Provided

  • Initial consultations (90-minutes, telehealth)

  • Follow-up consultations (45-minutes, telehealth)

  • Treatment plan development (emailed as a link)

  • Herbal medicine dispensing (via online distributers or privately)

  • Nutritional advice

  • Lifestyle support

  • Email support (with limits)

All services are provided in accordance with Australian healthcare regulations and Naturopathic best practices.

6. What we DON'T offer

  • Emergency medical services (call 000 or present to the hospital)

  • Diagnosis or treatment of serious/acute conditions

  • Prescription medications

  • Services outside the scope of naturopathy

7. Delivery Method

  • Online consultations via SimpleClinic

  • Email / messaging follow-up

  • Digital treatment plans sent via email

8. Client Responsibilities

8.1 The client must:

  • Provide accurate and complete health information

  • Disclose all medications, supplements and health conditions

  • Inform the practitioner of any changes to health status

  • Inform their GP of naturopathic treatments (recommended)

  • Take responsibility for their own health decisions

  • Not use these services if under 18 years of age without parent / guardian consent

  • Have stable internet connection for telehealth

  • Be in a private, quiet space for consultations

  • Be located within Australia / New Zealand during consultations

  • Complete payment before appointment

  • Complete intake form at least 24 hours before initial appointment

  • Take all medicines and supplements as directed

  • Inform the practitioner immediately of any adverse reactions

  • Check with your prescribing doctor before taking herbal medicines alongside prescription medications

  • Store medicines appropriately as instructed

8.2 The client must NOT:

  • Discontinue prescribed medications without consulting prescribing doctor

  • Delay seeking medical care for serious conditions

  • Record sessions without permission

  • Share login credentials or access

10. Fees & Payment

10.1 Pricing Structure

Consultation fees are available on our booking system. All prices are in Australian dollars (AUD). As we are not registered for GST, GST is not included in our prices. Payment is required in full at time of booking. Prices are subject to change with reasonable notice. Full payment terms, accepted payment methods, cancellation fees, and refund policies are outlined in our Booking Policy.

10.2 Late Policy

Consultations begin and end at the scheduled times. If you arrive late to your appointment, the consultation will still end at the originally scheduled time and the full duration cannot be extended. We recommend logging in 5-10 minutes early to test your internet connection and ensure a prompt start, enabling you to get the most out of each session.

Late arrivals of more than 20 minutes without prior notice to the practitioner will be considered a no-show, your payment will be forfeited and you will need to rebook and pay a new consultation fee.

We understand that sometimes things happen that are out of your control. Exceptional circumstances including but not limited to serious illness, family emergency or natural disaster, may be subject to a credit or refund at the discretion of the practitioner. You must provide notice as soon as possible.

11. Telehealth-Specific Terms

11.1 Technology Requirements

  • Stable internet, device with working camera and microphone

  • Private, quiet location during the consultation

11.2 Technical Failures

  • If connection is lost at any point during the consultation, an attempt to reconnect will be made.

  • If the issue lies on the patient-side, is unexpected and not at fault of the patient, a subsequent appointment may be offered to the patient at the practitioners discretion. However, if a poor connection is evident from the beginning of the consultation, connection is lost and attempt at reconnection fails, the practitioner is not obligated to reschedule a subsequent appointment at no cost to the patient.

  • If the issue lies on the practitioner-side, a full refund or reschedule of appointment will be offered to the patient.

12. Treatment Plans & Advice

12.1 Nature of Advice

All advice, treatment plans and recommendations are:

  • Based on the health information you provide

  • Educational and advisory in nature

  • Subject to your autonomous health decisions

We may recommend pathology testing, imaging or specialist referrals where appropriate. You are responsible for following through with these recommendations.

I am not liable for outcomes if:

  • You provide inaccurate or incomplete health information

  • You choose not to follow treatment recommendations

  • You discontinue treatment without informing me

Treatment plans may be modified based on your progress and response. Follow-up consultations are recommended to monitor outcomes and adjust treatment as needed.

12.2 Herbal Medicine Dispensing and Supplements

12.2.1 Quality & Safety:

  • All herbal ingredients are TGA-listed and sourced from reputable, GMP-certified suppliers

  • Custom herbal formulas are prepared specifically for you based on your individual health needs

  • Dispensing fees are separate from consultation fees

12.2.2 Contraindications & Interactions:

  • I screen for potential herb-drug interactions based on the information you provide

  • I am not liable for adverse reactions if you withhold information about medications, supplements or health conditions

  • Some herbs may be contraindicated during pregnancy, breastfeeding or with certain medical conditions

12.2.3 Returns & Refunds:

  • Custom herbal formulas cannot be returned or refunded once dispensed due to health and safety regulations

  • Unopened, sealed supplement products may be eligible for refund within 7 days if unopened and in original condition

12.2.4 Shipping

  • Postage fees and delivery times may vary

  • Risk transfers to you upon dispatch

  • Lost or damaged items should be reported within 3 days

13. Intellectual Property

All content on this website, including text, images, logos, treatment plans, handouts and educational resources are the intellectual property of Living Well Naturopathy and are protected by copyright.

You receive a personal, non-transferable licence to use treatment plans and resources for your own health purposes only.

You may not:

  • Reproduce, distribute or sell any materials

  • Use content for commercial purposes

  • Share treatment plans with others commercially

  • Claim authorship of materials

14. Informed Consent

14.1 By using our services, you consent to:

  • Naturopathic assessment, advice and treatment

  • Telehealth delivery of consultations

  • Collection and use of your health information as per our Privacy Policy

  • The inherent risks associated with natural therapies

  • Potential herb-drug and supplement-drug interactions (disclosed to the best of my knowledge)

14.2 You acknowledge that:

  • Natural therapies are not guaranteed cures

  • Individual results vary

  • Some treatments require time to show therapeutic effects

  • Your compliance with recommendations affects treatment outcomes

  • You have the right to ask questions and seek clarification at any time

15. Complaints Process

If you have a concern or complaint:

Step 1: Contact me directly via email or phone. I will respond within 5 business days and aim to resolve the matter promptly.

Step 2: If the matter is not resolved to your satisfaction, you may lodge a complaint with:

  • NHAA (Naturopaths and Herbalists Association of Australia)

  • Office of the Australian Information Commissioner (OAIC) - for privacy complaints: 1300 363 992 or www.oaic.gov.au

  • Queensland Office of Fair Trading - for consumer matters

16. Third-Party Links

We may give you access to third-party tools or platforms (e.g., payment processors or SimpleClinic software) that we do not control or manage.

Use of any such third-party tools is at your own risk and subject to their terms and conditions.

17. Termination

I may terminate our professional relationship if:

  • You repeatedly breach these terms

  • You engage in inappropriate behaviour (harassment, abuse, threats, intimidation)

  • Non-payment of fees

  • Your case is outside my scope of practice

  • You are not engaging with the treatment plan or recommendations

  • The therapeutic relationship has broken down

You may terminate at any time by notifying me.

Upon termination:

  • A final invoice will be issued for any outstanding fees

  • Medical records will be provided upon request

  • Referral to another practitioner can be arranged if appropriate

  • Refund eligibility is subject to our Booking Policy

18. Testimonials & Reviews:

  • Client feedback and testimonials are appreciated

  • I will request your written permission before publishing any testimonial

  • You may request removal of your testimonial at any time

19. Treatment of Minors

For clients under 18 years of age:

  • Parent or legal guardian must provide consent

  • Parent/guardian must be present during consultations (or immediately available)

  • Parent/guardian is financially responsible for all fees

20. Limitation of Liability

To the fullest extent permitted by law, I am not liable for:

  • Indirect, consequential or punitive damages

  • Outcomes resulting from your health decisions

  • Third-party service failures

  • Events beyond my reasonable control

Maximum liability is limited to fees paid for the specific service.

20.1 Australian Consumer Law:

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law that cannot be excluded by agreement.

21. Force Majeure

I am not liable for failure to provide services due to circumstances beyond reasonable control, including natural disasters, pandemics, government restrictions, or platform outages.

I will make reasonable efforts to notify affected clients and reschedule where possible.

22. General Legal Terms

22.1 Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

22.2 Entire Agreement: These Terms and Conditions, together with our Booking Policy and Privacy Policy, constitute the entire agreement between us and supersede any prior agreements or representations.

22.3 Waiver: Failure to enforce any provision does not waive my right to enforce it in the future.

22.4 Governing Law: These terms are governed by the laws of Queensland, Australia, and are subject to Australian federal laws. Both parties submit to the exclusive jurisdiction of the Queensland courts.

22.5 Amendments: I reserve the right to update these Terms and Conditions at any time. Changes will be communicated via email and/or website notice. For material changes, 30 days' notice will be provided where practicable. Continued use of services after changes take effect constitutes acceptance of the updated terms.
